# GALLERYOILART Terms of Service

These Terms of Service ("Terms") govern your use of galleryoilart.com and any purchase from GALLERYOILART ("GALLERYOILART," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms and the policies linked on the Site. If you do not agree, please do not use the Site.
## 1. Eligibility and acceptable use
You must be legally able to enter into a contract in your place of residence. You may not use the Site or our products for an unlawful purpose, to infringe another person’s rights, to upload malicious code, to interfere with Site security, or to copy, scrape, resell, or exploit Site content without our written permission.
## 2. Products and artwork
GALLERYOILART offers original oil paintings, decorative art, and custom products. Each hand-painted work may contain natural variations in brushwork, texture, color, and surface. Product photographs are intended to represent the work accurately, but screen settings and lighting can affect how colors appear.
Product availability, descriptions, sizes, frames, options, and prices may change without notice. We may correct errors, limit quantities, or cancel an order when necessary, including where a listing or price contains an obvious error. If we cancel a paid order, we will refund the amount paid for the canceled order.
## 3. Custom portraits and YMQ options
Custom portrait products may allow you to choose a size and frame and upload a reference photo through product options provided by the YMQ app. The price shown before adding the item to the cart is the price submitted to checkout, subject to Shopify’s final order confirmation.
You confirm that you have permission to use every reference image, name, likeness, or instruction you submit. You must not upload unlawful, hateful, infringing, or abusive material. Custom products are made for you and are subject to the GALLERYOILART Return and Refund Policy.
## 4. Orders, payment, and account information
You agree to provide accurate, current billing, shipping, contact, and payment information. An order is accepted only when we or Shopify issue an order confirmation; an automated confirmation acknowledges receipt and does not guarantee acceptance if an error or fraud concern is identified.
Payment is handled by the payment provider selected at checkout. You authorize that provider to charge the order total, including selected size, frame, shipping, tax, and other displayed charges.
## 5. Shipping, taxes, returns, and refunds
Shipping estimates, customs information, and packaging options are described in our Shipping Policy. Returns, exchanges, damaged deliveries, and custom-order cancellations are governed by our Return and Refund Policy. Mandatory consumer rights in your country are not limited by these policies.
## 6. Intellectual property
The Site, brand elements, photography, artwork images, text, layout, code, and other content are owned by or licensed to GALLERYOILART and are protected by applicable intellectual-property laws. You may view and use the Site for personal, non-commercial shopping only. No license is granted to reproduce, distribute, modify, or commercially use our content without written permission.
You retain ownership of content you submit, but grant us a limited, non-exclusive license to host, process, reproduce, and share it with service providers only as needed to provide the requested service, fulfill an order, or provide customer support. We will not publicly market a customer’s reference image without separate permission.
## 7. Third-party services and links
The Site may use Shopify, YMQ, payment services, analytics, shipping carriers, and other third-party services. Their own terms and privacy policies may apply. We are not responsible for third-party websites, services, or content outside our control.
## 8. Disclaimer and limitation of liability
To the fullest extent permitted by law, the Site and its content are provided on an “as available” basis. We do not guarantee uninterrupted or error-free operation. Nothing in these Terms excludes liability that cannot legally be excluded, including mandatory consumer protections, fraud, or personal injury caused by negligence where applicable.
To the extent permitted by law, GALLERYOILART will not be liable for indirect, incidental, special, or consequential loss arising from use of the Site or a product. Where liability cannot be excluded, it is limited to the amount paid for the affected order, except where applicable law requires otherwise.
## 9. Indemnity
You agree to reimburse GALLERYOILART for reasonable losses or claims arising from your unlawful use of the Site, your breach of these Terms, or your infringement of another person’s rights, except to the extent caused by our own unlawful conduct.
## 10. Changes and severability
We may update these Terms by posting a revised version. Continued use of the Site after an update means you accept the revised Terms. If a provision is found unenforceable, the remaining provisions continue to apply.
## 11. Governing law
These Terms are governed by the applicable laws of the jurisdiction where GALLERYOILART is legally established, without limiting mandatory consumer rights in your place of residence. Add the registered business name and jurisdiction before publication if required by your lawyer or payment provider.
